License Agreement.

1. This is a license, not a sale

This End User License Agreement ("EULA") is between you and AwayCam and governs your use of the AwayCam application, including the menu-bar app and its camera extension (together, the "Software"). Installing or using the Software does not transfer ownership of it to you. You are granted a license to use it under the terms below — the Software itself, including all intellectual property in it, remains owned by its copyright holder.

2. Scope of license

Subject to your compliance with this EULA, you're granted a personal, non-exclusive, non-transferable, revocable license to install and use the Software on Macs you own or control, for your own personal or business use. If you purchase Pro, this license extends to the Pro features for as long as your purchase or subscription remains valid. This license does not permit use on behalf of third parties as a hosted or managed service.

3. Restrictions

You agree not to:

• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the compiled Software, except to the extent applicable law expressly permits despite this restriction.
• Redistribute, sell, rent, lease, sublicense, or otherwise make the Software available to third parties.
• Modify, adapt, translate, or create derivative works based on the Software.
• Remove, obscure, or alter any copyright, trademark, or other proprietary-rights notices contained in or on the Software.
• Circumvent or attempt to circumvent any licensing, entitlement, or purchase-verification mechanism.
• Use the Software for anything other than looping your own recorded camera feed — see the acceptable-use rules in our Terms of Service.

AwayCam is proprietary, all rights reserved. Nothing in this EULA grants you any right to copy, modify, redistribute, or create derivative works from the Software or its code beyond the personal-use license described above.

4. Ownership

The Software, including all code, design, text, graphics, and the AwayCam name and mark, is and remains the property of its copyright holder. This EULA does not grant you any rights to trademarks or service marks. All rights not expressly granted to you are reserved.

5. Updates

We may release updates, patches, or new versions of the Software from time to time. Updates may be applied automatically or require your action, and may add, change, or remove features. This EULA applies to any updates unless a different license accompanies them.

6. Termination

This license is effective until terminated. It will terminate automatically, without notice, if you fail to comply with any term of this EULA — including the restrictions in Section 3. Upon termination, you must stop using the Software and delete all copies of it from your devices. Sections 3 through 9 survive termination.

7. Disclaimer of warranties

The Software is provided "as is," without warranty of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, or that the virtual camera will work with every meeting application or macOS configuration.

8. Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Software, even if we have been advised of the possibility of such damages. Our total liability under this EULA will not exceed the amount you paid for the Software, if any.

9. Export compliance

You may not use or export the Software except as authorized by the laws of the jurisdiction in which you obtained it and any other applicable laws and regulations, including export-control and sanctions laws. You represent that you are not located in, or a resident or national of, any country subject to a comprehensive export embargo, and that you are not on any government restricted-party list.

10. How Pro purchases are licensed

AwayCam is distributed directly from awaycam.app, not through the Mac App Store. Pro purchases are processed by our payment provider on the website; you receive a license key that unlocks Pro when entered in the app. The key is tied to your purchase, not to a hardware ID or account — treat it like the receipt it functions as, and don't share or redistribute it. If AwayCam is ever offered through the Mac App Store, purchases made there instead go through Apple's In-App Purchase system, and your use of the Software is then also subject to Apple's Licensed Application End User License Agreement (the standard Apple EULA) for that channel only.
