1. Acceptance of these terms

By downloading, installing, or using AwayCam (the "Software"), you agree to these Terms of Service. If you don't agree, don't use the Software. If you're using AwayCam on behalf of an organization, you're confirming you have the authority to bind that organization to these terms.

2. What AwayCam is

AwayCam is a native macOS menu-bar app and virtual camera. It lets you record a short loop of yourself and switch your meeting-app camera to that loop while you step away — so your on-camera presence stays steady while you're briefly gone. Everything runs on-device: there's no cloud processing, no account, and no server AwayCam talks to. See the Privacy page for the full detail.

3. License grant

AwayCam is proprietary software — all rights reserved. It is not open source, and no license is granted to use, copy, modify, redistribute, or build derivative products from its code. Downloading and running the app grants you a personal, non-exclusive, non-transferable license to use the Software as described in the End User License Agreement, which these Terms incorporate by reference. No other rights are granted, by implication or otherwise.

4. Acceptable use

AwayCam is built for one purpose: to loop your own recorded camera feed while you step away from your desk. When you use AwayCam, you agree that:

• You will only record and loop yourself — footage you have every right to use, of your own likeness.
• You will not use AwayCam to impersonate another person, or to make it appear that someone else is present when they are not.
• You will not use AwayCam as a face-swap, avatar, or deepfake tool. It replays a clip you recorded — it does not generate, synthesize, or alter faces.
• You will not use the Software to deceive anyone in a way that causes harm — for example, misrepresenting your attendance or attention in a context where that materially matters (a legal proceeding, an exam, a safety-critical meeting).
• You will not attempt to circumvent, disable, or interfere with any licensing, entitlement, or purchase-verification mechanism in the Software.

5. Purchases and subscriptions

Pro is sold as a one-time Lifetime purchase, or a Monthly or Annual subscription, plus a 7-day free trial that requires no card. AwayCam is distributed directly (not through the Mac App Store), so purchases are processed by our payment provider on awaycam.app, not through Apple — after paying, you'll receive a license key to activate Pro in the app. Your purchase is also governed by that provider's own terms, shown at checkout. If AwayCam is ever offered through the Mac App Store, purchases made there instead go through Apple's In-App Purchase system and are governed by Apple's Media Services Terms and Conditions. 6. No warranty

The Software is provided "as is" and "as available," without warranty of any kind, express or implied — including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Software will be uninterrupted, error-free, or that any virtual camera device will be recognized by every third-party meeting application.

7. Limitation of liability

To the maximum extent permitted by law, in no event will AwayCam, its author, or its contributors be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of — or inability to use — the Software, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising from these Terms or the Software will not exceed the amount you paid us, if any, in the twelve months before the claim arose.

8. Termination

These Terms remain in effect until terminated. We may suspend or terminate your license to use the Software if you materially breach these Terms, including the acceptable-use rules in Section 4. You may stop using AwayCam and uninstall it at any time. Sections that by their nature should survive termination — including license restrictions, warranty disclaimers, and limitation of liability — will survive.

9. Changes to these terms

We may update these Terms from time to time, for example as features change or to clarify existing language. If we make material changes, we'll update the "Last updated" date at the top of this page. Continuing to use AwayCam after changes take effect means you accept the revised Terms.

10. Governing law

These Terms are governed by the laws of the jurisdiction in which the AwayCam developer is established, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the courts of that jurisdiction.
